WMAQ Chicago - The Sierra Mist® "The Office" Sweepstakes
Official Rules
May 5, 2008 - June 1, 2008

  1. PRELIMINARY INFORMATION: NO PURCHASE NECESSARY. A purchase will not improve one's chances of winning. Void outside the WMAQ terrestrial geographic viewing area and where prohibited. The WMAQ Chicago - The Sierra Mist® "The Office" Sweepstakes ("Sweepstakes") begins on May 5, 2008, at 12:00:01 A.M. and ends on June 1, 2008, at 11:59:59 P.M. ("Sweepstakes Period"). Including this Sweepstakes, there will be a total of six (6) separate, concurrent Sierra Mist® "The Office" Sweepstakes (collectively, "Promotions") conducted in the terrestrial geographic viewing areas of the following NBC Universal stations: WNBC/New York; KNBC/Los Angeles; WMAQ/Chicago; WTVJ/Miami; WVIT/Hartford; and KNSD/San Diego. (To view the Official Rules of the sweepstakes of a station other than WMAQ/Chicago, go to that station's website during the Sweepstakes Period.) Each Promotion will have its own prize offerings and odds of winning. The one (1) National Grand Prize (described below) will be awarded in a random drawing from among all eligible entrants in all the Promotions. The winner of the National Grand Prize will not necessarily be an entrant from this Sweepstakes. All times in this Sweepstakes refer to Central Time.
  2. TO ENTER: Access the WMAQ website at www.nbc5.com and click on the Sweepstakes icon or text link. Complete and thereafter submit the entry form, including your first and last name, complete address (including zip code), daytime telephone number (including area code), date of birth, e-mail address and the correct ten-letter code ("Sierra Mist Code") (collectively "Entry Information"). The Sierra Mist Code can be learned, without making a purchase, from posted point-of-sale signage at Ultra Foods and Strack and Van Til Supermarkets during regular business hours during the Sweepstakes Period. (For a complete list of local participating retailers, go to www.nbc5.com) The Sierra Mist Code will be prominently displayed on the Sweepstakes website. Your Entry Information and the correct Sierra Mist Code will together constitute your entry into this Sweepstakes ("Entry"). Entries must be received by June 1, 2008, at 11:59:59 p.m. All Entries become the property of NBC Universal, Inc., and WMAQ (collectively, "Sponsors") and will not be acknowledged or returned. Limit one (1) Entry per person/email address per day. Entries in excess of the stated limit will be disqualified. All required Entry Information and Sierra Mist Code must be completed in full. Any attempted form of entry other than as described herein is void. Entries generated by a script, macro, or other automated means will be disqualified. Entries that are incomplete, garbled, corrupted or unintelligible for any reason including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. In case of a dispute over the identity of an entrant who made a potentially winning Entry, Sponsors reserve the right to deem that the Entry was made by the registered subscriber of the email address submitted at the time of Entry. Entry must include the correct Sierra Mist Code. Entry constitutes permission (except where prohibited by law) to use entrant's name, city, state, likeness, image, and/or voice for purposes of advertising, promotion, and publicity in all media, as determined by Sponsors in their sole discretion, without additional compensation.
  3. ELIGIBILITY: Open only to permanent, legal U.S. residents who are physically located in the WMAQ terrestrial geographic viewing area (the counties of Cook, De Kalb, Du Page, Grundy, Kane, Kankakee, Kendall, Lake, La Salle, McHenry, and Will in the state of Illinois; and the counties of Jasper, Lake, La Porte, Newton, and Porter in the state of Indiana (collectively, "Geographic Area")) and who are eighteen (18) years of age or older and the age of majority in their state of residence as of May 5, 2008. Entrant may not be, or intend to be within six (6) months from his/her date of Entry, a candidate for any public office, a professional performing artist, or a member of SAG, AFTRA, AGVA, Equity, or any other guild or union associated with the performing arts. Entrant must have either a valid social security number and/or a valid U.S. personal tax identification number. Officers, directors, and employees of PepsiCo, Inc., Pepsi-Cola Company, PepsiAmericas, Inc., The Pepsi Bottling Group, Inc., and Sweepstakes Entities; members of these persons' immediate families (spouses and/or parents, children, and siblings, and their spouses); and/or persons living in the same households as such persons (whether or not related thereto) are ineligible to enter the Sweepstakes. Sweepstakes Entities, as referenced herein, shall include Sponsors and Sweepstakes administrator, Ultra Foods and Strack and Van Til Supermarkets, and their respective parent, subsidiary, and affiliate companies and administrative, advertising, and promotion agencies and any other entity involved in the development, administration, promotion, or implementation of the Sweepstakes.
  4. WINNER SELECTION AND NOTIFICATION: One hundred (100) second prize winners (collectively, "Second Prize Winners") and one (1) first prize winner ("First Prize Winner") will be selected in a random drawing by Sweepstakes administrator on or about June 16, 2008 ("Drawing Date"), from all eligible Entries received in this Sweepstakes. One (1) national grand prize winner ("National Grand Prize Winner") will be selected in a random drawing by Sweepstakes administrator on or about the Drawing Date from all eligible Entries received in all the Promotions. Sponsors will make one (1) attempt to notify Second Prize Winners by mail on or about September 9, 2008. Sponsors will make two (2) attempts to notify First Prize Winner and National Grand Prize Winner at the phone number and/or email address submitted at the time of Entry within approximately twenty-four (24) hours of the Drawing Date. National Grand Prize and First Prize Winners may be required to execute and return an affidavit of eligibility, release of liability, publicity release (except where prohibited), and IRS Form W-9 (collectively, "Sweepstakes Documents") within five (5) days of such notification. Noncompliance within this time period will result in disqualification, and an alternate Winner may be selected from the remaining eligible Entries. If a Winner cannot be reached, if he/she is found to ineligible, if he/she cannot or does not comply with these Official Rules, or if his/her prize or prize notification is returned as undeliverable, such Winner will be disqualified and an alternate Winner may be selected from the remaining eligible Entries.
  5. PRIZES/ODDS OF WINNING: Second Prizes: There will be one hundred (100) second prizes awarded in this Sweepstakes (collectively, "Second Prizes"), each consisting of the following: one (1) DVD copy of "The Office: The Complete Fourth Season" ("The Office: The Complete Fourth Season" DVD releases September 9, 2008). Approximate Retail Value ("ARV") of each Second Prize is sixty dollars ($60). Total ARV of all Second Prizes is six thousand dollars ($6,000). First Prize: There will be one (1) first prize awarded in this Sweepstakes ("First Prize"), consisting of the following: two thousand five hundred dollars ($2,500). First Prize will be awarded in the form of a check made out in the name of the First Prize Winner. ARV of First Prize is two thousand five hundred dollars ($2,500). Odds of winning a Second Prize or the First Prize depend upon the number of eligible Entries received in this Sweepstakes. National Grand Prize: There will be one (1) national grand prize awarded from among all eligible entrants in all the Promotions ("National Grand Prize"). National Grand Prize consists of the following: one (1) trip to Los Angeles, California ("Trip"), for National Grand Prize Winner and his/her guest ("Guest"), and an opportunity for National Grand Prize Winner to participate in a non-speaking walk-on role ("Appearance") as an extra in the taping ("Taping") of an upcoming episode ("Episode") of the NBC television show "The Office." Actual Episode will be chosen by Sponsors in their sole discretion. Trip includes round-trip, coach-class air travel from a major commercial airport near National Grand Prize Winner's residence (as determined by Sponsors in their sole discretion) to a major commercial airport near Los Angeles (as determined by Sponsors in their sole discretion) ("LA Airport"); standard accommodations (single room/double occupancy) for three (3) nights at a hotel (as determined by Sponsors in their sole discretion) ("Hotel"); ground transportation between LA Airport and Hotel; and ground transportation between Hotel and location of Taping. ARV of Trip is three thousand two hundred and fifty dollars ($3,250). Appearance has no cash equivalent value. ARV of National Grand Prize is three thousand two hundred and fifty dollars ($3,250). Odds of winning the National Grand Prize depends upon the number of eligible Entries received in all the Promotions. Limit one (1) Second Prize per family or household. Once selected, the First Prize Winner will not be eligible to win the National Grand Prize. ARV of National Grand Prize varies depending on the point of departure and fare fluctuation for the Trip. Any differences between stated ARV and actual ARV will not be awarded. Sponsors reserve the right to provide two (2) tickets to the Tonight Show with Jay Leno ("Tonight Show"), ground transportation between Hotel and Tonight Show, and three hundred dollars ($300) (in the form of a check to be made out to the Winner) in lieu of air transportation for National Grand Prize Winner if he/she resides with in one hundred (100) miles of Los Angeles, CA or within one hundred (100) miles of San Diego, CA (actual date and taping of Tonight Show to be determined by Sponsors in their sole discretion); awarded ONLY if National Grand Prize Winner resides within one hundred (100) miles of Los Angeles, CA or within one hundred (100) San Diego, CA). First Prize Winner will receive an IRS Form 1099 from Sponsors for the total ARV of the First Prize for the calendar year in which the First Prize was won. National Grand Prize Winner will receive an IRS Form 1099 from Sponsors for the total ARV of the National Grand Prize (and the total ARV of the Second Prize, if Second Prize Winner is also the National Grand Prize Winner) for the calendar year in which the National Grand Prize was won. National Grand Prize Winner must take the Trip in conjunction with the dates of the Taping (as determined by Sponsors in their sole discretion), or the Appearance will be forfeited and no additional compensation will be awarded. If National Grand Prize Winner cannot take Trip in conjunction with the Taping (as determined by Sponsors in their sole discretion), National Grand Prize Winner will have one (1) year from the date of notification of winning to take Trip, and no additional compensation will be awarded. If Trip is not taken within one (1) year of notification of winning, it will be forfeited. If Episode is not in production or is cancelled prior to or pre-empted during the Appearance, the remaining elements of National Grand Prize shall constitute full satisfaction of Sponsors' Prize obligation to National Grand Prize Winner and no additional compensation will be awarded. If National Grand Prize Winner fails to appear in a timely manner for the Appearance, as determined by Sponsors in their sole discretion, the Appearance may be forfeited. No person other than National Grand Prize Winner and persons deemed necessary by Sponsors may be present at the Appearance. The nature of the Appearance will be determined by the Sponsors in their sole discretion. Sponsors are not obligated to have the National Grand Prize Winner make the Appearance or to broadcast or otherwise use or exploit the Episode or any part thereof. If Sponsors, in their sole discretion, elect to incorporate the audio and video recording of the Appearance ("Recording"), the Appearance and/or the Recording will not be considered an employment opportunity, and National Grand Prize Winner will not be entitled to compensation or credit therefor. The nature of the Recording will determined by Sponsors in their sole discretion. If the Recording is broadcast, such broadcast will be at a time, for a length of time, and on a date determined by Sponsors in their sole discretion. National Grand Prize Winner will be required to execute and return appearance and location releases and such other documents as may be required by Sponsors ("Appearance Documents"). If National Grand Prize Winner fails to execute and return Appearance Documents in a timely manner, as determined by Sponsors in their sole discretion, Appearance may be forfeited. The content of the Recording as, and if, finally broadcast, and the number of broadcasts and re-broadcasts thereof, if any, will be determined by Sponsors in their sole discretion. National Grand Prize Winner will have no right of review, notice, or approval of the content of the Recording or any broadcast thereof. Sponsors reserve the right to disqualify National Grand Prize Winner and remove him/her from the Episode at any time, if his/her behavior at any point is deemed by Sponsors to be disruptive, if it may or does cause damage to person, property, or reputation of Sponsors or otherwise violates the policies thereof, or if National Grand Prize Winner does not follow the directions of Sponsors at all times. These Official Rules and the Sweepstakes are neither a contract nor an application for employment. Details of Prize will be determined by Sponsors in their sole discretion. Sponsors reserve the right to substitute a Prize (or Prize element) of equal or greater value for any reason at their sole discretion. All federal, state, and local laws and regulations apply. No groups, clubs, or organizations may reproduce or distribute any portion of these Official Rules to their members. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prize are the sole responsibility of Winner. Prize cannot be transferred by Winner or redeemed for cash and is valid only for the items detailed above, with no substitution of Prize by Winner. If a Prize is unclaimed, it will be forfeited and an alternate Winner may be selected from the remaining eligible Entries. If a Prize element is not available for any reason, as determined by Sponsors in their sole discretion, the remaining elements of Prize shall constitute full satisfaction of Sponsors' Prize obligation to Winner and no additional compensation will be awarded. Certain blackout periods and travel restrictions may apply to the Trip. Travel and Hotel arrangements will be determined by Sponsors in their sole discretion. Once determined, no change, extension, or substitution of Trip dates is permitted, except by Sponsors in their sole discretion. Guest must be eighteen (18) years of age or older and the age of majority in his/her state of residence as of May 5, 2008. National Grand Prize Winner and Guest must travel together on the same itinerary. National Grand Prize consists only of the elements set forth above; no other travel elements (including, without limitation, ground transportation, insurance, gasoline, meals, gratuities, souvenirs, etc.) are included in National Grand Prize. Airline and Hotel reservations are subject to availability. Airline tickets must be issued thirty (30) days prior to date of departure or thirty (30) days after reservation is made, whichever comes first. All taxes and fees assessed at the time of ticketing are the responsibility of National Grand Prize Winner. Tickets are non-refundable and are not valid for business-related or group travel. Tickets are valid only for travel on airline chosen by Sponsors in their sole discretion. Trip must be completed within one (1) year of notification of winning or National Grand Prize will be forfeited. Tickets will be issued only to National Grand Prize Winner and Guest. Tickets are void if sold for cash or other consideration. National Grand Prize Winner is responsible for any tax liability, including applicable departure taxes or fees, inspection charges, and security charges. Once issued, tickets are non-transferable and may not be reissued once travel has commenced. Open tickets may not be issued and stopovers are not permitted. Travel arrangements must be made through Sponsors. National Grand Prize Winner and Guest must have required travel documents (e.g., valid, government-issued photo identification and/or passport) prior to departure. Sponsors shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of National Grand Prize due to reasons beyond Sponsors' control, and are not responsible or liable for any expenses incurred as a consequence thereof. Travel may not be combined with any other offer. All travel will be at the risk of National Grand Prize Winner and Guest. Sponsors will not replace any lost or stolen tickets, vouchers, or certificates. All elements of National Grand Prize must be redeemed at the same time. In the event of an act of God or an unforeseen, uncontrollable event, Sponsors reserve the right to reschedule all travel for a later date. Guest, if any, may be required to execute and return a releases of liability and, except where prohibited, publicity release (collectively, "Guest Documents"), which must be returned with the Sweepstakes Documents, or National Grand Prize will be forfeited and an alternate National Grand Prize winner may be selected from the remaining eligible Entries. If National Grand Prize Winner chooses to take the Trip with no Guest, the remaining elements of National Grand Prize shall constitute full satisfaction of Sponsors' Prize obligation to National Grand Prize Winner and no additional compensation will be awarded. First and Second Prizes, Prize notifications and applicable Sweepstakes Documents will be mailed/shipped to a street address within the Geographic Area only. National Grand Prize notification and applicable Sweepstakes Documents will be mailed/shipped to a street address within the Geographic Areas of all the Promotions only. Sweepstakes administrator is not the supplier or guarantor of any Prize.
  6. CONDITIONS: By entering the Sweepstakes, each entrant agrees for entrant and for entrant's heirs, executors, and administrators (a) to release and hold harmless PepsiCo, Inc., Pepsi-Cola Company, PepsiAmericas, Inc., The Pepsi Bottling Group, Inc., and Sweepstakes Entities, and their respective officers, directors, and employees (collectively, "Released Parties") from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant's participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of Prize or any portion thereof; (b) to indemnify Released Parties from any and all liability resulting or arising from the Sweepstakes and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by Prize supplier that are sent along with Prize; (c) if selected as a Winner, to the posting of such entrant's name on www.nbc5.com and the use by Released Parties of such name, voice, image, and/or likeness for publicity, promotional, and advertising purposes without additional compensation, and, upon request, to the giving of consent, in writing, to such use except where such requirement is prohibited by law; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Sweepstakes itself, and to be bound by all decisions of the Sponsors, which are binding and final. Failure to comply with these conditions may result in disqualification from the Sweepstakes.
  7. ADDITIONAL TERMS: Sponsors reserve the right to permanently disqualify from any promotion any person they believe has intentionally violated these Official Rules. Any attempt to deliberately damage the Sweepstakes or the operation thereof is unlawful and subject to legal action by Sponsors, who may seek damages to the fullest extent permitted by law. The failure of Sponsors to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsors (excepting compliance with applicable codes and regulations), or other "force majeure" event will not be considered a breach of these Official Rules. Released Parties assume no responsibility for any injury or damage to entrants' or to any other person's computer relating to or resulting from entering or downloading materials or software in connection with the Sweepstakes. Released Parties are not responsible for telecommunications, network, electronic, technical, or computer failures of any kind; for inaccurate transcription of entry information; for errors in any promotional or marketing materials or in these Official Rules; for any human or electronic error; or for entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned. Sponsors reserve the right to cancel, modify, or suspend the Sweepstakes or any element thereof (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules). In the event of cancellation, modification, or suspension, Sponsors reserve the right to select Winners in a random drawing from among all eligible, non-suspect entries received at the time of the event warranting such cancellation, modification, or suspension. Notice of such cancellation, modification, or suspension will be posted at www.nbc5.com. Sponsors may prohibit any entrant or potential entrant from participating in the Sweepstakes, if such entrant or potential entrant shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsors, or Sponsors' agents or representatives; or behaves in any other disruptive manner (as determined by Sponsors in their sole discretion).
  8. DISPUTES: THE SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEW YORK, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN NEW YORK, NEW YORK. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF ("JAMS RULES"). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN NEW YORK. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF NEW YORK. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY'S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
  9.
